Terms & Conditions

TERMS AND CONDITIONS OF EVENT ATTENDANCE

These Terms and Conditions apply to the attendance at, events (“Event(s)") organised by Agricultural Publishers Pty Limited trading as ACM Rural Events (ABN 55 000 560 430) (“Organiser”).

The Organiser is a subsidiary of Rural Press Pty Limited trading as Australian Community Media ("ACM”). 

These Terms and Conditions apply to the attendee, and any ticket holder whether or not they purchased their ticket (collectively, “You”). 

Please read these Terms and Conditions carefully before attending an Event. By attending any Event, You agree to be bound by these Terms and Conditions.

Variation to Terms and Conditions

  1. The Organiser may vary these Terms and Conditions at any time by updating them and posting them on the Event website or otherwise by notifying You. 

Use of your Personal Information

  1. ACM’s Privacy Policy is incorporated into these Terms and Conditions.

TICKETS

Number of check-in tickets

When registering for check-in tickets to the Event, You will receive one ticket per attendee. Only check-in ticket QR holders are permitted to enter the Event site.

Ticketing errors

  1. If Your error results in the Organiser reprocessing the check-in attendee ticket registration at Your request, the Organiser may charge You the Organiser’s actual costs incurred in reprocessing the ticket QR, including any chargeback to the Organiser by a third party.

Exchanges and replacements

  1. Check-in attendee tickets may not be exchanged. If a check-in ticket is used in breach of this condition, the ticket will be cancelled, and the attendee holder of the ticket will be refused entry. The Organiser will use reasonable efforts to notify You of such action.

The Organiser will only replace lost, stolen, damaged or destroyed electronic tickets if the authenticity of the check-in ticket can be verified, including proof of attendee, and if You give reasonable notice before the Event. The Organiser may charge a reasonable fee for the replacement of check-in attendee tickets. You should carefully consider the cancellation policies of travel, accommodation and other goods or service providers when making arrangements for attendance at an Event. 

Sale of tickets & scalping

  1. Check-in attendee tickets may not be sold (including via on-line auction or other unauthorised resale sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If a check-in ticket is sold or used in breach of this condition, the ticket will be cancelled, and the attendee holder of the ticket will be refused entry. The Organiser will use reasonable efforts to notify You of such action.
  2. SCALPING WARNING: The sale of check-in attendee tickets in certain circumstances is governed by ticket sales legislation and may attract criminal penalties.

EVENT

Ticket QR presentation

  1. You must present your ticket QR code at the point of attendee entry at the Event.

Variations to Events

  1. The Organiser reserves the right to add, withdraw, reschedule, substitute and/or vary advertised Event programs, Event directories, prices, venues, COVID compliance and audience capacity at its discretion.

Conditions of entry

Admission to an Event may be subject to the Organiser’s additional terms of Entry as notified to You or displayed at an Event including mandatory requirement to present your check-in ticket QR code upon attendance. In particular, the following form part of the Organiser’s terms of entry:

  1. You may be denied entry into, or removed from, an Event where the Organiser has reasonable grounds to do so, or otherwise if the Organiser considers you have breached these Terms and Conditions or the Organiser’s Code of Conduct, or you are intoxicated, under the influence of illicit drugs or adversely affecting the enjoyment of the Event by others.
  2. You will be required to check-in at the event, before entering.
  3. No pets permitted on the Property at any time during the Event (including bump in and bump out). With the exception of guide dogs or assistance animals for the vision impaired, service dogs for medical or disability requirements and animals approved by the Organiser involved in official demonstrations and displays.
  4. You may be required to submit to a search of your person and/or possessions before entering the Event.
  5. By attending the Event, You agree that You may be filmed and/or recorded and You give permission to the Organiser to use Your image, likeness and voice obtained at the Event in all media throughout the world for any purpose and without compensation.
  6. You agree to comply with all government directions, orders and regulations relevant to attending live events, which may be in place at the time of the Event.

    COVID-19 specific conditions of entry

You acknowledge that an Event may be scheduled to be held, or will be held, during a time at which one or more Government directions, orders or regulations may be in force, including regarding the number of attendees, the Event itself and/or validation of vaccination. If so, the Organiser may:

  1. Cancel or postpone the Event.
  2. Reduce the number of persons who may attend the Event; and/or
  3. Impose requirements for the purpose of complying with such directions or regulations

You must comply with all Government directions, orders and regulations relevant to attending the Event.

  1. You must commit to stopping the spread of COVID-19. If at the time of the Event, You are feeling unwell or are subject to a self-quarantine or self-isolation period, You agree not to attend the event. If You do attend the Event, You agree to assume all risk associated with COVID-19.

Authenticity and validity of tickets

  1. You may be refused entry to an Event if the Organiser considers that your electronic ticket is not authentic or valid or has not been registered with the Organiser or other authorised points of sale.
  2. GENERAL TERMS The term “including” when used in these Terms and Conditions is not a term of limitation.

PROMOTION TERMS AND CONDITIONS

  1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is only open to residents of Queensland, New South Wales, Northern Territory and Western Australia aged 18 years or older
  3. Directors, management, employees, officers and contractors (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
  4. Promotion commences on 15th April 2025 and closes 3 pm AEST on 5 June, 2025 (“Promotional Period”).
  5. To enter, eligible entrants must, during the Promotional Period, purchase Farmfest tickets online at Farmfest.com.au. All eligible online ticket purchases will be automatically entered into the draw.
  6. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  7. Incomplete or indecipherable entries will be deemed invalid.
  8. Only one (1) entry permitted per person.
  9. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  10. The draw will take place by computerised random selection at ACM - 309 Kent Street, Sydney NSW 2000 on 10th June, 2025 at 2 pm AEST, with winners notified by phone and email within 2 working days, including instructions on how to claim their prize. The Winner name will be published on the Farmfest website (www.farmfest.com.au) on 19th June.
  11. The Promoter reserves the right to draw additional reserve entries and record them in order in case of an invalid entry or ineligible entrant.
  12. If there are any unclaimed or un-awarded prizes a prize redraw will be conducted by computerised random selection at 12pm on 17th September 2025 at ACM, 309 Kent Street, Sydney-, 2000, with winners notified by phone and email within 2 working days, including instructions on how to claim their prize. Winner name(s) will be published in the farmfest.com.au on 24th September 2025.
  13. The Promoter’s decision is final and no correspondence will be entered into.
  14. The first valid entry drawn will win a Z200 series 42-inch Kubota Zero-turn Mower, from Black Truck & Ag valued at $10,000 inc GST.
  15. The winner of the draw can pick-up their Z200 42-inch series Kubota Zero-turn Mower from Black Truck & Ag – 22 Carrington Road, Toowoomba, QLD 4350.
  16. If for any reason the winner does not take the prize (or an element of the prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
  17. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to the directions of any regulatory authority.
  18. Total prize pool value is up to $10,000 inc GST. Prize, or any unused portion, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  19. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  20. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate, subject to the directions of any regulatory authority.
  21. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  22. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  23. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
  24. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. The Promoter will otherwise collect, hold, use and disclose PI as set out in its Privacy Policy, which can be viewed at https://acm.media/privacy-policy/. All entries become the property of the Promoter.
